Ashley Madison is a service that promotes itself as providing a discrete way for married members to have to have an extramarital affair. Hackers recently leaked onto the internet a massive amount of information about Ashley Madison members including member names. Public evidence of a spouse’s extramarital affair will not provide assistance for a spouse in obtaining a Florida divorce, since Florida’s “no fault” divorce laws no longer require proof of fault in order to get divorced. Rather, all that is required is for one spouse to testify that the marriage is “irretrievable broken.” This, however, does not mean that one spouse’s discovery of the now public evidence of their partner’s affair through Ashley Madison may not lead to their decision to seek divorce. In fact, it would be reasonable to think that the enormous violation of Ashley Madison’s “discrete” services may very well lead to the demise of many of its members’ marriages.
